Apple Wins Court Battle Over iCloud Storage Claims

A federal appeals court in the United States has dismissed allegations from Apple customers who claimed the company provided less iCloud data storage than they had paid for upon upgrading their plans.

The 9th US Circuit Court of Appeals in San Francisco rendered a unanimous 3-0 decision, stating that reasonable consumers within the proposed class action would not likely be deceived by Apple’s representation of storage capacity in its iCloud+ offerings.

The case involved plaintiff Lisa Bodenburg, who asserted that she paid $2.99 monthly for 200 GB of storage, under the impression that this would be added to the existing 5 GB provided to all iCloud users. Instead, she contended that she only received 200 GB in total, rather than the anticipated 205 GB.

Circuit Judge Milan Smith remarked that Bodenburg “received exactly what Apple promised her,” explaining that the company was offering “incremental” or “supplemental” storage in addition to the initial 5 GB provided for free.

Judge Smith referenced prior dismissals of cases based on “unreasonable assumptions,” including instances regarding Diet Dr. Pepper’s potential for weight loss and concerns over lip balm labeling that did not make clear the accessibility of the product within its dispenser.

“Apple’s statements are not false and deceptive merely because they may be unreasonably misunderstood by an insignificant and unrepresentative segment of consumers,” Smith stated in his ruling.

Attorneys for Bodenburg have not yet responded to inquiries for comment following the decision, which upheld a dismissal from May 2024 by US District Judge Trina Thompson in San Francisco.
